This Home At Last Adoption Contract (“Contract”) is made as of “Effective Date” by and between Home At Last Dog Rescue (“Home At Last”) and "Adopter" residing at indicated address. Home At Last is a volunteer organization that allows people to adopt dogs that are in need of forever homes. Adopter is seeking to adopt a dog to give it a forever home. The parties desire to establish an agreement for the adoption as set forth herein. Accordingly, the parties, intending to be legally bound, hereby agree as follows: In consideration of payment of adoption fee , the receipt of which is hereby acknowledged, Adopters do hereby release Home At Last and any other person, firm, or corporation charged or chargeable with liability, their heirs, administrators, executors, successors, and assigns from any and all claims, damages, costs, expenses, loss of services, actions, and causes of action belonging to said Adopter arising out of any act or occurrence from the present time and particularly on account of the adoption of a companion dog, hereto referred to as indicated in below fields:
Adopter agrees and understands that said dog was previously unwanted and may have been rescued from a dangerous, unhealthy, and/or cruel situation, which may have impacted said dog's emotional and/or physical state.
Adopter agrees that Home At Last is making no representation or warranty about the temperament or health of said dog and is not liable to Adopter for any claims, losses, demands, judgments, or costs incurred whatsoever by Adopter in connection with said dog.
Adopter agrees and understands that Home At Last has represented the physical and medical condition of this dog as accurately as possible. Adopter recognizes that said dog is susceptible to illness, disease, or the like which can affect the condition of said dog. Adopter understands that it is his/her sole responsibility to have any emotional, physical and/or medical condition or injury to said dog treated promptly. Adopter must bear all costs associated with any treatment as of the Contract Execution and agrees to notify Home At Last if the dog exhibits signs of illness within 14 days of Effective Date PRIOR to seeking veterinary care so that Home At Last may make necessary precautions for potential communicable diseases.
Adopter agrees and understands that Home At Last cannot be responsible for said dog after the Contract Execution when the Adopter accepts legal, custodial, and financial responsibility for the dog and its actions.
Adopter agrees and understands that all dogs will be surgically sterilized before being adopted. When medical reasons deem otherwise a dog may be placed with an adopter prior to sterilization. If this occurs with said dog, Adopter agrees to have it sterilized at a HAL approved Veterinarian prior to an agreed upon date. Adopter agrees to have it sterilized prior to an agreed upon date by a HAL approved veterinarian (at HAL'S expense) or a veterinarian of Adopter's choosing (at Adopter's expense). HAL will reimburse $100.00 if Adopter provides proof that sterilization has been done by a non-HAL approved veterinarian.
Some dogs are adopted while under medical treatment. If this is the case with said dog, Home At Last has advised Adopter with a Medical Addendum what treatment they must continue to give the dog.
Adopter will comply with all applicable local ordinances and state laws having to do with caring for said dog, including licensing and vaccinating.
Adopter will provide all necessary shelter, food, and water for said dog.
Adopter will provide said dog with proper routine vet care including annual well visits, vaccinations, preventatives and tests for common conditions such as heartworm & lyme disease.
Said dog will not be kept outside; it must live indoors as a member of the family.
Under no circumstance will said dog be trained as an attack, guard, or fighting dog.
Adopter agrees to make a serious effort to find said dog if it becomes lost, by immediately (a) filing lost dog report with local police, animal control authorities, animal shelters, SPCAs, and veterinarians, (b) posting lost dog signs and (c) contacting Home At Last.
Adopter agrees to follow-up from Home At Last via phone or email at one day, one week and 6 weeks post adoption. Adopter agrees to allow Home At Last to inspect the living arrangements and/or general health of said dog at any time after the Effective Date.
In the event that Adopter can no longer adequately care for said dog, Adopter agrees to immediately contact Home At Last. Adopter agrees that said dog must be returned to Home At Last and will give the rescue a minimum three weeks to find an available foster home. ADOPTER AGREES NOT TO ABANDON, GIVE AWAY, SELL, SURRENDER, OR DISPOSE OF SAID DOG WITHOUT THE WRITTEN CONSENT OF HOME AT LAST.
Adopter agrees that if Home At Last accepts return of said dog at any point after Contract Execution, NO REFUND of any amount will be given to Adopter.
Adopter understands that Home At Last has disclosed any and all known information about said dog to the best of its knowledge including suggested breed composition, and Home At Last shall take no responsibility for any problems (medical, behavioral, or otherwise) that arise after the Contract Execution. Home At Last does not guarantee size of dog when full grown.
Should Adopter not comply with any of the above requirements, Adopter will return or surrender said dog upon demand to Home At Last within 24 hours of written request.
Failure by Adopter to comply with any of the above requirements is a breach of contract. Adopter agrees to pay $1500.00 liquidated damages to Home At Last within 14 days of written notice by Home at Last, a Home At Last representative and/or attorney representing Home At Last. Failure to comply within specified time of liquidated damages payment will result in legal action and Adopter agrees to pay all reasonable attorney fees and court costs incurred by Home At Last to facilitate breach of contract resolution/judicial process.
This written Agreement is the entire agreement between Home At Last and Adopter, and supersedes any prior understandings between the parties with respect to the subject matter hereof. No modification of this Agreement will be valid unless in a writing duly signed by both a Home At Last representative and Adopter. This Agreement is binding on the parties and their successors, heirs, assigns, executors, and administrators. By signing this contract, I (We) agree to abide by all the terms and conditions of this agreement, including statements 1 - 19
