This Home At Last Agreement (“Contract”) is made between Home At Last Dog Rescue Inc. (“Home At Last” and/or “HAL”) and “Volunteer” (indicated via First and Last name provided on this application). Home At Last is a volunteer organization that allows people to adopt dogs that are in need of forever homes. Volunteer is seeking to provide service(s) until the dog(s) finds a forever home. The parties desire to establish an agreement as set forth herein. Terms & Conditions: 1. Volunteer’s services to HAL are provided strictly in a voluntary capacity and without any express or implied promise of salary, compensation, reimbursement, or other payment of any kind whatsoever. Volunteer’s services are furnished without any employment-type benefits, including, but not limited to, employment insurance programs, worker's compensation accrual, vacations, or sick time. 2. HAL will provide current versions of HAL’s policies and procedures, and any updates, to Volunteer promptly. 3. Volunteer will familiarize him/herself and comply with HAL’s policies and procedures. Volunteer understands that HAL expects high standards of moral and ethical treatment of the animals under its care and will adhere strictly to these standards in capacity as a Volunteer. 4. Volunteer agrees that HAL, without notice or hearing, may terminate Volunteer’s services at any time with or without reason. 5. Volunteer may terminate his/her services as a Volunteer, with or without reason, upon fourteen (14) calendar days’ notice to HAL. 6. Volunteer recognizes that HAL may, from time to time, supply Volunteer with certain non-perishable items (“HAL Property” ), including, but not limited to, crates, leashes, food bowls, etc., for the benefit of the animals under the care of Volunteer. 7. Upon termination of this Contract, Volunteer shall return all HAL Property promptly and, in any event, prior to the expiration of the fourteen (14) day notice period. Or, if terminated by HAL, within fourteen (14) calendar days after termination. Accordingly, the parties, intending to be legally bound, hereby agree as follows: 1. Volunteer agrees that HAL is making no representation or warranty about the temperament or health condition of a HAL dog. Volunteer understands the risk of harm presented by the handling of animals & other volunteer activities on behalf of HAL. Volunteer agrees to provide services at his/her own risk & to be solely responsible for any damages to people/property caused by the dog(s) while in his/her care. On behalf of self & heirs, personal representatives & assigns, Volunteer hereby releases, discharges, indemnifies & holds harmless HAL, its directors & volunteers from any & all claims, causes of action and demands of any nature, whether known or unknown, arising out of or in connection with activities on behalf of HAL. 2. Volunteer understands that fostering is not an adoption and that animals in his/her care are still the property of HAL. Volunteer will not abandon, sell, give away or transfer in any way a HAL dog to any other person or entity unless adoption is performed and paid for according to HAL procedures and guidelines. 3. Volunteer will take the animal in for medical checkups if required. Volunteer will ONLY take a HAL animal to a HAL approved veterinarian. Volunteer will NOT take any HAL animal to the veterinarian without HAL board/ medical team member approval unless there is a true medical emergency. If Volunteer chooses to take a HAL animal to a HAL-approved veterinarian without prior approval, unless it is an emergency, or to a non-HAL approved veterinarian, HAL will not be responsible for any expenses incurred. 4. Volunteer will provide all necessary shelter and care for HAL animal (approved medical care will be paid by HAL). Volunteer will comply with all applicable city ordinances and state laws having to do with caring for this animal. 5. Should Volunteer not comply with all HAL requirements, Volunteer will be required to return the dog to HAL. 6. Should Volunteer be unable to foster a dog to which s/he has committed, Volunteer must give a minimum of 72 hours’ notice to a HAL board member so a new foster home can be found. 7. Shelter dogs may arrive with health conditions that can be contagious to other dogs. Additionally, behavior can be unpredictable. Volunteer understands that HAL advises foster dogs be kept separate from personal pets until the foster dog can be observed to be healthy & temperament is deemed appropriate. HAL will not be responsible for any costs incurred for personal pet treatment or care. 8. Volunteer agrees to keep all personal dogs up-to-date on vaccinations and licensed in the County in which they live. Current rabies certificate and dog license should be kept on Volunteer’s premises at all times. Volunteer agrees to comply with all requirements set forth by HAL regarding documentation for the Dog Warden. 9. Volunteer understands and agrees that HAL is dependent upon its IT Resources (as hereinafter defined), for its day-to-day activities and for the successful marketing and adoption of the animals under its care. It is essential that all of the information technology systems utilized by HAL, including but not limited to, the HAL administration system and network, HAL Facebook page (public page and private volunteer page), HAL Petfinder profile, HAL Instagram account, HAL Twitter account, as well as any other information technology resources (the “IT Resources”) are protected and HAL maintains availability, integrity, confidentiality and security of its IT Resources, including the data contained therein. Volunteers are prohibited from (i) causing a security breach to any of the IT Resources, including but not limited to, accessing data, servers or account to which Volunteer is not authorized; (ii) circumventing user authentication to any IT Resource; (iii) causing a disruption of service to an IT Resource or other network resources; or (iv) intentionally introducing malicious code or sending spam messages. To the extent Volunteer violates any of the foregoing or if there is a breach in confidentiality, security or if there is deemed inappropriate use of the IT Resources to create negative publicity for HAL, or otherwise, it is in HAL’s sole discretion to withdraw a Volunteer’s access to any or all of the IT Resources, and/or terminate Volunteer’s services. 10. Volunteer is fully aware of, understands, and agrees to all of the terms and conditions of this CONTRACT AND INDEMNIFICATION PROVISION, and that it is BINDING AND ENFORCEABLE BY LAW. I understand that the statements/answers herein are made subject to the penalties of 18 PA C.S.A. Sec. 4904 relating to unsworn falsification to authorities.
